Warranty Terms and Conditions of CLICKWERK GmbH


1. General Warranty Commitment

CLICKWERK GmbH, Walter-Becker-Straße 44, 21035 Hamburg, Germany ("CLICKWERK"), grants the customer ("end customer") an additional voluntary manufacturer's warranty ("warranty"), free of charge, in addition to statutory warranty rights, for all products marketed under the CLICKWERK brand ("products"). This warranty exclusively covers material and manufacturing defects that significantly impair the intended function and safety of the products. The warranty period is twenty-five (25) years, beginning on the verifiable date of initial commissioning of the products by the end customer, but at the latest six (6) months after the date of delivery by CLICKWERK.

2. Persons Entitled to Warranty

This warranty applies exclusively to the original purchaser ("customer") who directly purchased the products from CLICKWERK GmbH. Eligible warranty recipients include end consumers (private individuals), commercial installation and assembly companies, as well as authorized commercial distributors and wholesale businesses ("original purchaser").

Explicitly excluded from warranty coverage are secondary purchasers of the products (such as customers of installers, dealers, or any other resellers) who did not directly acquire the products from CLICKWERK.

Warranty rights are not transferable to third parties and apply solely to the original purchaser who concluded the direct purchase agreement with CLICKWERK.

3. Scope and Content of the Warranty

The warranty of CLICKWERK GmbH exclusively covers material and manufacturing defects that substantially impair or prevent the proper functionality, safety, and technical performance of the CLICKWERK products.

Specifically excluded from warranty coverage are:

  • Aesthetic impairments such as discoloration, surface changes, or other purely cosmetic alterations that do not affect functionality.
  • Normal wear and tear resulting from regular and intended use of the products.
  • Damages or defects arising from external mechanical impacts, improper handling, negligence, or intentional actions.

In a warranty case, CLICKWERK undertakes, at its discretion, to perform one of the following:

  • Free repair of the defective product or affected product components.
  • Free provision of an equivalent replacement product of identical type, function, and quality.
  • Refund of the proportional current market value of the product, considering the actual period of use and the remaining lifespan of the product.

Additional services and obligations, such as expenses or costs for dismantling defective products, transportation costs (shipping to and from the customer), reinstallation, or installation of the repaired or replacement product, as well as any other indirect or additional costs, are explicitly not included in this warranty and will not be borne by CLICKWERK.

4. Conditions for Claiming the Warranty

Warranty claims can only be asserted if all of the following conditions are cumulatively met:

  • The installation and commissioning of CLICKWERK products must have been professionally conducted strictly according to the applicable assembly, operating, and maintenance instructions provided by CLICKWERK at the time of installation.
  • The products must have been installed and operated in strict compliance with the relevant technical standards (especially applicable DIN, EN, and VDE standards) and all applicable building regulations and official permits valid at the time of installation.
  • All maintenance and servicing must be demonstrably performed according to CLICKWERK guidelines. Improper maintenance or unauthorized service by third parties entirely excludes warranty claims.
  • The product must not have undergone any modifications, alterations, or repairs not explicitly authorized in writing by CLICKWERK or by authorized CLICKWERK contractual partners.
  • Warranty claims must be asserted promptly, at the latest within six (6) weeks after discovery of the defect, in writing to CLICKWERK with complete documentation. This documentation specifically includes the proof of purchase or invoice, installation/commissioning date, detailed description of the defect, and informative photographic documentation.

5. Exclusions and Limitations of Warranty Liability

Explicitly excluded from warranty coverage are damages, defects, or functional impairments caused by:

  • Force majeure and extraordinary environmental or natural events such as storms, hail, lightning strikes, floods, earthquakes, avalanches, fires, or comparable unforeseen events.
  • Accidents, vandalism, negligent or intentional damages, or any form of improper or unintended use of the products.
  • Failure to comply with the installation instructions, technical documentation, or structural calculations explicitly prescribed by CLICKWERK, safety instructions, and all relevant building regulations and statutory standards.
  • Normal wear and tear that may occur through regular and proper use of the product, not significantly impairing function.
  • Components made from rubber, plastic, or similar materials serving auxiliary or purely aesthetic purposes, provided they are not essential to structural stability or safety-relevant functionality.
  • Damages due to insufficient or neglected maintenance, incorrect cleaning, improper storage, or handling by the customer or unauthorized third parties.
  • Modifications, repairs, or interventions performed by persons or service providers not explicitly authorized in writing by CLICKWERK.

CLICKWERK also assumes no liability for indirect consequential damages, financial losses, lost profits, or revenues, production interruptions, or damages resulting from failure or limited usability of the product.

6. Procedure for Handling Warranty Claims

In case of a warranty claim, the end customer must inform CLICKWERK immediately, at the latest within six (6) weeks from discovering the defect, in writing. The warranty claim must include the following information and documents:

  • Complete contact details of the end customer (name, address, telephone number, email address).
  • Proof of purchase (invoice or delivery note) clearly showing the delivery date.
  • Proof of the date of the initial commissioning of the product or system.
  • Precise description of the identified defect, including when it was first noticed.
  • Clear photographic and, if necessary, video documentation verifying the reported damage or defect.

The customer is explicitly not entitled to return the affected product or product components to CLICKWERK or hand them over to third parties without prior written approval from CLICKWERK.

CLICKWERK reserves the right to inspect the reported products on-site through its employees or experts commissioned by CLICKWERK. The customer explicitly agrees to cooperate and grant access to the respective products or installations.

Recognition of a warranty claim will only be given through explicit written confirmation by CLICKWERK. In the event of claim rejection, CLICKWERK will communicate the reasons for denial to the customer in writing.

Any measures undertaken by the customer without explicit written approval from CLICKWERK are at the customer’s own expense and responsibility.

7. Limitation and Extent of Liability

The liability of CLICKWERK under this voluntary warranty is strictly limited to the remedies explicitly outlined (repair, replacement, or partial reimbursement). Maximum liability is limited to the original purchase price of the product.

Any further claims, especially for indirect or consequential damages such as production losses, lost profits, usage interruptions, additional installation costs, or lost revenues, are explicitly excluded.

8. Spatial and Temporal Validity

This warranty applies only to products delivered by CLICKWERK or authorized distributors within the European Union and the initial non-EU country of product delivery. The warranty period is twenty-five (25) years from the initial commissioning date, ending automatically afterward without possibility for extension.

10. Applicable Law and Jurisdiction

German law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Hamburg is the exclusive jurisdiction for disputes involving commercial customers, public entities, or special public assets.
